Terms & Conditions

Welcome to Paso Patisserie. These Terms & Conditions ("Terms") govern your use of our website, purchase of bakery and dessert products, and rental or booking of our dessert carts, displays, equipment, and related services.

By placing an order, submitting an inquiry, making a reservation, renting equipment, or using our website, you agree to these Terms. If you do not agree with these Terms, please do not place an order or make a reservation.

We reserve the right to update these Terms from time to time. The Terms in effect at the time of your order or reservation will generally apply to that transaction.

1. Products and Services 

Paso Patisserie may offer:

  • Cakes, cupcakes, cookies, pastries, desserts, and other baked goods

  • Dessert boxes and custom dessert orders

  • Dessert tables and displays

  • Dessert cart rentals

  • Dessert cart packages that include food, décor, serving items, or staffing

  • Delivery and setup services

  • Pickup services

  • Custom event and celebration packages

  • Other products and services described on our website

Product availability, flavors, designs, colors, decorations, and package options may change without notice.

2. Custom Orders

Custom orders must be approved and confirmed by [Business Name] before they are considered booked.

Customers are responsible for providing accurate information, including:

  • Event date

  • Event time

  • Delivery or venue address

  • Number of guests

  • Desired products

  • Flavor selections

  • Design preferences

  • Color preferences

  • Personalized wording or names

  • Venue restrictions

  • Setup requirements

  • Contact information

We will make reasonable efforts to follow approved designs and specifications. However, handmade and custom products may have minor variations in color, size, shape, decoration, and appearance.

Reference photographs are considered inspiration unless otherwise agreed upon in writing.

3. Pricing

Prices displayed on the website may be subject to change.

A quoted price is not considered a final booking price until the customer receives confirmation from Paso Patisserie.

Custom orders, delivery, setup, staffing, specialty ingredients, rush orders, additional rental items, taxes, and other services may result in additional charges.

The final price will be communicated to the customer before the order or booking is confirmed.

4. Deposits and Payment

A deposit or retainer may be required to reserve an order date, event date, dessert cart, or other service.

Unless otherwise stated in writing:

  • The deposit is applied toward the customer's total balance.

  • A reservation is not guaranteed until the required payment has been received.

  • Remaining balances must be paid by the deadline stated on the invoice or booking agreement.

  • Orders that are not paid in full by the required deadline may be subject to cancellation.

  • Additional charges incurred after booking may be billed separately.

Accepted payment methods may include credit card, debit card, electronic payment, cash, or other payment methods offered by Paso Patisserie.

5. Cancellation and Rescheduling

Cancellation and rescheduling policies may vary depending on the type of order or event.

For custom bakery orders and dessert cart rentals, cancellation requests must be submitted in writing.

Deposits or retainers may be non-refundable because they compensate Paso Patisserie for reserving the date, declining other bookings, purchasing supplies, and beginning preparation.

If a customer requests to reschedule, [Business Name] may accommodate the request subject to availability.

Rescheduling is not guaranteed, and additional fees may apply depending on the timing and circumstances of the request.

6. Dessert Cart Rentals

Dessert carts and related rental equipment remain the property of Paso Patisserie unless otherwise stated in writing.

Rental items may include, but are not limited to:

  • Dessert carts

  • Display stands

  • Trays

  • Risers

  • Signage

  • Serving equipment

  • Décor

  • Table coverings

  • Containers

  • Decorative accessories

Rental items may only be used for the event and purpose for which they were rented.

Customers may not sell, transfer, sublease, modify, paint, drill, attach permanent fixtures to, or otherwise alter rental equipment without written permission.

7. Care of Rental Equipment

The customer is responsible for reasonable care of rental equipment while it is in the customer's possession, at the event venue, or under the customer's control.

The customer may be responsible for repair or replacement costs resulting from:

  • Loss

  • Theft

  • Damage

  • Misuse

  • Negligence

  • Unauthorized modifications

  • Excessive staining

  • Burns

  • Breakage

  • Water damage

  • Exposure to unsafe weather conditions

  • Damage caused by guests, vendors, children, pets, or other persons at the event

A security deposit may be required for certain rentals.

Any applicable security deposit will be returned after the rental items have been inspected, less any documented charges for damage, loss, cleaning, repair, or replacement.

8. Delivery and Setup

If delivery and setup are included in the customer's package, the customer must provide accurate venue information and reasonable access to the setup area.

The customer is responsible for notifying Paso Patisserie of:

  • Parking restrictions

  • Loading zones

  • Elevators

  • Stairs

  • Security requirements

  • Venue access procedures

  • Required vendor insurance

  • Setup restrictions

  • Limited access times

  • Other venue requirements

Additional fees may apply for circumstances that require excessive waiting time, additional labor, stairs, long-distance carrying, multiple trips, or other conditions not disclosed at the time of booking.

9. Venue Access

The customer is responsible for obtaining permission from the venue for [Business Name] to enter, deliver, set up, operate, and remove rental equipment.

Paso Patisserie is not responsible for delays caused by a venue, event coordinator, property manager, security personnel, parking restrictions, or lack of venue access.

If the venue prevents setup or delivery after Paso Patisserie has arrived, applicable delivery, labor, and service charges may still apply.

10. Dessert Cart Setup and Staffing

Unless expressly included in the customer's package, rental of a dessert cart does not necessarily include an attendant, server, bartender, decorator, or event staff.

If staffing is included, the number of staff members and hours of service will be specified in the customer's booking agreement.

Additional service time may be subject to additional charges and availability.

11. Food Handling and Leftovers

Once food has been delivered to or accepted by the customer, responsibility for proper storage, handling, temperature control, and serving conditions may transfer to the customer or event venue. Paso Patisserie is not responsible for food quality or safety issues resulting from improper storage, handling, exposure to heat, contamination, or extended periods outside appropriate storage conditions after delivery or pickup. Customers should follow any storage and serving instructions provided with their order.

12. Allergies and Dietary Restrictions

Our products may contain or come into contact with common allergens, including but not limited to:

  • Wheat

  • Milk

  • Eggs

  • Soy

  • Peanuts

  • Tree nuts

  • Sesame​

Products may be prepared in an environment where allergens are present.

Although we will make reasonable efforts to accommodate disclosed dietary restrictions, we cannot guarantee that any product will be completely free from allergens or cross-contact.

Customers are responsible for informing their guests about potential allergens.

If you or a guest has a severe food allergy, please contact us before placing an order so that we can determine whether we can safely accommodate the request.

13. Product Appearance

Because many of our products are handmade, slight variations may occur.

Examples include variations in:

  • Color

  • Texture

  • Shape

  • Size

  • Piping

  • Decoration

  • Packaging

  • Placement of decorative elements​

Colors may also appear differently depending on lighting, photography, screens, and printing.

We will make reasonable efforts to reproduce approved designs while maintaining the quality and structural integrity of the product.

14. Outdoor Events and Weather

Customers booking outdoor events are responsible for providing a reasonably safe and suitable environment for food and rental equipment.

For outdoor dessert cart rentals, customers may be required to provide:

  • Adequate shade

  • Protection from rain

  • Protection from excessive heat

  • A stable and level surface

  • Appropriate access to the setup area

Paso Patisserie may postpone, modify, relocate, or cancel setup if weather or environmental conditions create an unsafe condition for employees, customers, guests, food, or equipment.

Weather-related changes do not automatically entitle the customer to a refund.

15. Damage, Loss, and Theft

The customer may be financially responsible for rental equipment that is lost, stolen, or damaged while under the customer's care or at the customer's event.

Charges may include reasonable costs for:

  • Repair

  • Replacement

  • Cleaning

  • Restoration

  • Lost rental time

  • Transportation

  • Labor​

The customer may also be responsible for damage caused by guests, vendors, venue personnel, pets, children, or other persons attending the event.

16. Customer-Provided Items

If customers provide decorations, serving pieces, signage, food, beverages, or other items to be incorporated into a dessert cart or display, [Business Name] is not responsible for damage, loss, contamination, spoilage, or incompatibility unless otherwise agreed in writing.

Customer-provided items must be delivered by the deadline communicated by Paso Patisserie

17. Delivery and Pickup

Delivery and pickup times are estimates unless a specific guaranteed time has been agreed upon in writing.

Customers must ensure that someone authorized to receive the order is available when required.

If no authorized person is available, additional delivery or waiting fees may apply.

For rental items, the customer must make the items available for pickup at the agreed-upon time and location.

18. Late Returns

Rental equipment returned late may result in additional fees.

Late fees may be charged when the delay prevents Paso Patisserie from fulfilling another customer's reservation or requires additional transportation, labor, or scheduling.

19. Customer Changes

Changes to an order, design, guest count, flavor, event location, delivery time, rental package, or other booking details are subject to availability.

Changes requested after the order has entered production may not be possible.

Additional charges may apply to approved changes.

20. Rush Orders

Rush or last-minute orders may be accepted at Paso Patisserie's discretion.

Rush fees may apply depending on the timing, complexity, ingredient availability, staffing requirements, and delivery requirements.

Payment may be required in full for rush orders.

21. Refusal or Cancellation by the Business

Paso Patisserie reserves the right to decline or cancel an order when reasonably necessary, including circumstances involving:

  • Unavailability of required ingredients

  • Equipment failure

  • Unsafe conditions

  • Staffing limitations

  • Venue restrictions

  • Severe weather

  • Emergencies

  • Circumstances beyond our reasonable control​

If Paso Patisserie cancels an order before fulfillment, we will communicate available options, which may include rescheduling or refunding amounts paid, subject to the circumstances and applicable law.

22. Force Majeure

Paso Patisserie will not be responsible for failure or delay caused by circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, power outages, transportation disruptions, government restrictions, venue closures, labor disruptions, emergencies, or other unforeseen events.

We will make reasonable efforts to communicate with customers and determine an appropriate solution.

23. Website Information

We make reasonable efforts to ensure that information on our website is accurate and current. However, occasional errors may occur regarding pricing, availability, descriptions, photographs, or other information.

We reserve the right to correct errors and update website information without prior notice.

24. Website Use

Customers agree not to:

  • Use the website for unlawful purposes

  • Attempt to interfere with website operation

  • Copy or reproduce website content without permission

  • Use our photographs, branding, logos, designs, or written content without authorization

  • Submit fraudulent orders

  • Provide false or misleading information

  • Attempt to gain unauthorized access to website systems​

25. Intellectual Property

All website content, including photographs, logos, graphics, designs, written content, product descriptions, branding, and other materials, belongs to Paso Patisserie or its respective owners unless otherwise stated.

Unauthorized reproduction, modification, distribution, or commercial use is prohibited.

26. Customer Photos and Reviews

If a customer voluntarily submits a review, photograph, testimonial, or other content to Paso Patisserie,  the customer grants permission for Paso Patisserie to use that content for marketing or promotional purposes, unless otherwise agreed in writing.

Customers may contact us if they do not want submitted content used for promotional purposes.

27. Privacy

Information submitted through our website may be collected and used to process orders, communicate with customers, provide services, process payments, and improve our business.

Our Privacy Policy, if applicable, explains how customer information is collected, used, and protected.

 

28. Limitation of Liability

To the extent permitted by applicable law, Paso Patisserie will not be liable for indirect, incidental, special, consequential, or unforeseeable damages arising from the use of our products, services, website, rental equipment, or event services.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived under applicable law.

29. Customer Responsibility

Customers are responsible for reviewing their order confirmation and notifying Paso Patisserie promptly if any information is incorrect.

Customers are also responsible for providing accurate event information and complying with venue requirements.

30. Disputes

Customers are encouraged to contact Paso Patisserie first regarding any concern, complaint, or dispute so that the parties may attempt to resolve the matter informally.

Agreement to Arbitrate

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the customer's purchase of products, rental of equipment, use of our services, website, event services, or these Terms and Conditions shall be resolved through binding arbitration rather than through a court proceeding, except where applicable law provides that a particular claim may not be subject to mandatory arbitration.

The arbitration shall be conducted by a mutually agreed-upon arbitrator or arbitration service in accordance with the applicable arbitration rules and California law.

The customer and Paso Patisserie agree that arbitration is intended to provide a prompt and efficient method for resolving disputes. The arbitrator, rather than a court, shall generally determine the resolution of arbitrable disputes, subject to any rights that cannot legally be waived.

Individual Claims

To the extent permitted by applicable law, arbitration shall be conducted on an individual basis. The customer agrees not to participate in a class action, collective action, or representative arbitration against Paso Patisserie to the extent such waiver is legally enforceable.

Small Claims Court

Nothing in this section prevents a customer from bringing an eligible individual claim in small claims court if applicable law permits the customer to do so and the claim falls within the jurisdictional requirements of that court.

Arbitration Costs

Allocation of arbitration fees and costs shall be determined in accordance with applicable law and the applicable arbitration provider's rules. Nothing in these Terms requires a customer to pay arbitration fees or costs that the customer cannot legally be required to pay.

Informal Resolution

Before initiating arbitration, the customer should contact Paso Patisserie in writing at pasopatisserie@gmail.com and provide a description of the dispute and the requested resolution. The parties will have a reasonable opportunity to attempt to resolve the dispute informally before arbitration is initiated.

Nothing in this section is intended to waive, limit, or restrict any consumer rights or remedies that cannot legally be waived under California or federal law.

31. Governing Law

These Terms shall be governed by the laws applicable in the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

32. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

33. Entire Agreement

These Terms, together with the customer's order confirmation, invoice, rental agreement, and any written agreements between the customer and Paso Patisserie constitute the agreement relating to the applicable transaction.

If there is a conflict between these Terms and a specific written agreement signed by both parties, the specific written agreement will control to the extent of the conflict.
